Chairman Richard Thomas:

The Freedom Of Information Act (FOIA) Act 442, 1976; Eff. Apr. 13, 1977 15.235 Sec. (2) states "Unless otherwise agreed in writing by the person making the request, a public body shall respond to a request for a public record within 5 business days after the public body receives the request by doing 1 of the following: Whereas the request copied below was sent to County Administrator Dennis Aloia on June 14, 2010 and five business days expired June 18th, 2010 and Whereas nothing has been received by request or I find the public body, Grand Traverse County, in violation of the FOIA Act and under Sec. 10 (a) Submit to the head of the public body a written appeal that specifically states the word "appeal" and identifies the reason or reason for reversal of the denial." Sec. (2) gives you 10 days after receiving this appeal, for failure to answer a FOIA request, to respond before Sec. 10 (1) (b) will be invoked. As this FOIA request was issued for actions already taken Sec. 10 (3) is not in force and the original request should at least have been acknowledged. It is difficult enough for a concerned citizen to discover what decisions are being made on my behalf, and to have my efforts thwarted by not making available the facts behind those decisions is why this Act was passed and should be supported by everyone who has nothing to hide. Let the Sun shine again. Do the right thing.
